Non-Alcoholic Beer Is Not A Panacea

First, if an officer observes the driver drinking what appears to be an “alcoholic” beverage while driving, the driver will likely be stopped and questioned. Generally, a driver’s constitutional rights require that an officer have either reasonable suspicion or probable cause that the driver is committing a crime or about ... Read More »

Saliva Testing Drivers For Marijuana/THC

Regular readers of this blog know that I try to keep them informed about new methods of detecting marijuana (THC) in the body of drivers.  For instance, you may wish to review my 2019 post here and my 2015 post here.  In addition to breath tests, a saliva test has now been studied.  If perfected, this method will likely be used by law-enforcement officers as part of their investigatory procedures to determine if someone is driving under the influence of ... However, the Court was ... Read More »

News Alert for Tennessee Motor Vehicle Habitual Offenders

Tennessee Governor Lee has signed into law an amendment repealing the Tennessee Motor Vehicle Habitual Offender Law (Tennessee Code Annotated 55-10-601, et seq.), more commonly known as the Tennessee Habitual Motor Vehicle Offender Law (HMVO).  Previously, those who qualified as habitual offenders were required to have their driver’s license revoked without any opportunity to drive on a restricted license. This meant that those who were declared habitual offenders were not allowed to drive at all for at least 3 years.  ... Read More »
