Attempts underway to boost DUI-death penalties

As a nationally recognized traffic safety prosecutor, Chief Deputy Prosecutor Tim Barker does not want to appear unappreciative. The Pennsylvania House of Representatives passed a bill recently mandating a minimum five-year prison term for drivers with prior DUI convictions who are then convicted of a DUI-related death. Tennessee has loophole in its DUI law, report says

MEMPHIS (AP) — A newspaper investigation has found that Tennessee has a loophole in its drunken driving law. The Commercial Appeal (http://bit.ly/1nJRGzQ) reports its analysis found that a person could potentially spend more time in jail for driving drunk and getting pulled over than for someone who causes a fatal accident while driving under the influence.   Read More »

Victim of DUI driver sues bars that served him

NASHVILLE, TN (WSMV) – The victim of a DUI driver has filed a lawsuit in federal court against the bars that served the man who allegedly hit him. Eduardo Chua is serving the drunk driver who struck him on Christmas Eve two years ago and the bars, Miss Kelli’s Karaoke and Bourbon Street Blues and Boogie Bar, which served the driver that night. Chiefs’ Sean Smith cited for DUI

KANSAS CITY, Mo. — Chiefs cornerback Sean Smith was cited for driving under the influence and careless driving after an officer witnessed him lose control and strike a light pole early Monday. According to a copy of the police report, Smith was attempting to make a turn in Kansas City’s Power & Light entertainment district when he struck the light pole around 12:30 a.m. The officer reported that Smith “appeared confused and began mumbling statements that I did not understand.” Read More »
