Can I Get a DUI for Riding My Bike While Intoxicated?

In beach cities throughout Orange County, it is common to see people riding their bikes at all hours of the day, including early mornings, daytime, and even the late hours of the night. However, did you know, under certain conditions, it is illegal to ride a bicycle? According to California Vehicle Code 21200.5 VC, it is illegal for a person to ride a bicycle while under the influence of alcohol, drugs, or a combination of the two. This type of offense is known as cycling under the influence or CUI.

What are the Consequences if Charged with CUI?

A person charged with a CUI can face the following consequences:

  • Fine up to $250
  • A misdemeanor that will be listed as a conviction on a criminal record (if convicted)
  • If under the age of 21, a person’s license may be suspended
  • May be charged with “Drunk in Public” (additionally)

How Can a Law Enforcement Detect if a Person is Riding Under the Influence?

In most cases, a law enforcement officer will attempt to determine whether a person is riding a bicycle under the influence by looking for the following qualities:

  • Slurred speech
  • Red or watery eyes
  • Flushed face
  • Odor of alcohol on the breath
  • Unsteady walking

Because many of these qualities are not extremely substantial when proving whether a person was intoxicated, many people are wrongfully accused of CUI. That is why it is wise for accused persons to contact experienced legal counsel right away. A seasoned attorney can challenge the arresting officer’s conclusion by stating why the arrested person had these physical qualities at the time of arrest.
