“Florida Man” arrested for Shopping Scooter DUI!

Can you be arrested for DUI on a shopping scooter? Florida Man stories abound and provide lots of entertainment for people around the country. In an absolutely absurd fashion, this latest “Florida Man” story again focuses attention on the Sunshine State. Although the body cam footage shows that the video is 2 years old, this story is now making the rounds on the internet.

Shopping Scooter DUI in Melbourne, FL!

In Melbourne Florida, police arrested a shopper for a Scooter DUI. A large bottle of vodka was found partially consumed in the shoppers backpack. Witnesses reported that while shopping at Walmart the man used a store electric scooter to ride around the aisle of the Walmart, crashing into shelves and nearly hitting other shoppers.

Eventually the police identified the shopper as Aaron Gregory. Mr. Gregory was arrested and charged with DUI, refusing to take a breath test, disorderly intoxication and open container violations.

Thankfully, the prosecutor took no action on the the Scooter DUI charge or the refusal to take a breath test, resulting in those charges being dismissed.

A Scooter DUI is a DUI!

Had Mr. Gregory been in the parking lot of the store or on the roadways, the DUI and refusal charges would likely have been prosecuted. Just because you are not driving a car, does not mean you cannot be charged with DUI. DUIs have been prosecuted when the driver is in a golf cart, a tractor, a scooter, a bicycle, and a motorized bar stool.
