Florida Breath Testers Not Registered

Stephen Daniels of DUI UNDO Consultants has announced a new challenge he discovered while spending time trolling the Florida Administrative Rules regarding breath testing in Florida.  Under Florida Administrative Code section 11D-8 which covers the testing of substances for alcohol in DUI cases, an evidentary breath test instrument must be registered prior to use.  The rules under 11D8-004(4) state that Department Inspectors shall be employed… to register evidentary breath test instruments…  Until the last 30 registrations, all breath test instruments ... Corrections officer facing DUI, child neglect charges

PORT ST. LUCIE, Fla. – A Treasure Coast correctional officer is accused of driving drunk with his two young kids in the car.  Douglas Schultz was pulled over in Port St. Lucie on Monday after he yelled at a police officer from his car. An officer reports that the two children inside Schultz’s car appeared frightened. Schultz is charged with child neglect and driving under the influence. Ocala mom arrested for DUI crash with 2-year-old autistic child in lap, 6-year old in back

OCALA —  A 28-year-old Marion County woman has been charged with DUI and child neglect after crashing into a tree with her two young children inside her car, including an autistic 2-year-old boy who was sitting on her lap. Suspect says she has no memory of fatal wrong-way crash

Coral Springs, FL – Sun Sentinel A woman accused of drunken driving in a wrong-way crash that killed two 21-year-old friends from Coral Springs says she has no recollection of the accident. Office Depot executive arrested in DUI

BOCA RATON — The recently named chief financial officer of Office Depot was arrested late Saturday on a DUI charge. A Boca Raton police officer pulled over Stephen E. Hare, 60, after spotting his Audi going 57 mph in a 35 mph zone at 11:33 p.m. Hare struggled to complete a field sobriety test, and breath tests showed his blood alcohol content was 0.180 and 0.186, more than twice the legal limit of 0.08. Dane Eagle arrested for DUI

Tallahassee, FL – Rep. Dane Eagle, R-Cape Coral, was arrested Monday morning and charged with DUI by Tallahassee police, according to the Tallahassee police. Eagle, 30, was driving a black SUV at about 1:50 a.m. after leaving a Taco Bell on W. Tennessee Street. Breath Tests Get Support In DUI Wars

TALLAHASSEE (CBSMiami/NSF) — Judges may have another way to help repeat DUI offenders sober up for good. Instead of blowing into a machine which keep their cars from starting, they may have to get their breath tested twice a day. The proposal, approved by a House committee last week, would allow judges to place repeat DUI offenders into a new program, known elsewhere as “24/7 Sobriety,” instead of having ignition interlock devices installed on their vehicles. Lightning’s Ryan Malone arrested on DUI, cocaine charges

Tampa Bay, FL – Tampa Bay Times Lightning left wing Ryan Malone was arrested early Saturday in Tampa and charged with driving under the influence and cocaine possession. Malone was released from Hillsborough County jail on $2,500 bond but did not travel with the team to Washington for today’s regular-season finale with the Capitals. Man crashed into deputies, charged with DUI

NASSAU COUNTY, Fla. — A Fernandina Beach man is facing careless driving DUI charges after being involved in a crash that injured two deputies Thursday night. According to a report from the Florida Highway Patrol, 25-year-old Stephen Lee Coleman rear-ended a Nassau County Sheriff’s Office cruiser as the officers approached the intersection of Miner Road, near Yulee Elementary School around 7:30 p.m. The deputies were taken to St. Vincents Hospital for treatment of minor injuries. Suspected DUI driver hits woman’s car in Orlando, drives away, FHP says

ORLANDO, Fla. – A man was arrested in Orlando early Monday on DUI charges after, according to troopers, he struck a woman’s car and drove away. Fabian Sanchez, 21, of Orlando, was arrested in the hit-and-run crash, which happened on Lake Underhill near State Road 408.
